Heard Mr. Tigde, learned Counsel for the Applicant and Mr. Malshe, learned APP for the Respondent-State. 2.

On the previous occasion, the Applicant had appeared in person. Mr. Tigde, learned Counsel, who is also appearing in the Trial Court states that the Applicant is not well and he has been hospitalized. He further states that he has gone through this Criminal Application. He states that as the contentions raised were regarding learned Chief Judicial Magistrate who was dealing with the case earlier therefore, he seeks withdrawal of the Criminal Sonali

Accordingly, the Criminal Application is allowed to be withdrawn and disposed of with liberty to file a fresh Criminal Application, if necessary.
