Mr. Shah, the learned Counsel for the Petitioner submits that the instant petition has become infructuous as Regular Civil Suit No.5 of 2012, wherein the Petitioner had sought amendment in the written statement, has been finally decided by the learned Civil Judge.

In view of the aforesaid submission, the petition stands disposed of having been rendered infructous.

This Court has not considered the merits of the matter and it would be open for the Petitioner to raise all the contentions, including the grounds in the instant petition, as permissible in law, in the appeal preferred by the Petitioner. [N. J. JAMADAR, J.] 1/1
