The Applicant has been convicted vide Judgment and Order dated 31.01.2017 passed by the learned Special Judge (Under the P.C.Act), Greater Mumbai, for the offence punishable under Section 7 of the Prevention of Corruption Act and has been sentenced to suffer S.I. for six months and to pay fine of Rs.8,000/-, in default to suffer S.I. for 30 days. The Applicant has also been convicted for the offence punishable under Sections 13(1)(d) r/w.13(2) of the
Prevention of Corruption Act and has been sentenced to suffer S.I. for six months and to pay fine of Rs.8,000/-, in default to suffer S.I. for 30 days.

Learned counsel for the Applicant states that the Applicant was on bail pending the trial and that even after his conviction, his sentence was suspended. He submits that the Applicant has deposited the fine amount in the trial Court.

Perused the papers.

By a separate order passed today, the aforesaid Appeal has been admitted. The Appeal is not likely to be heard in the immediate near future.

Considering the short term sentence and the fact that the Applicant has not misused
and/or abused liberty granted to him whilst on bail, the Applicant's sentence is suspended and he is enlarged on bail on the following terms & conditions:
O R D E R
(i) The applicant be enlarged on bail, on executing PR Bond in the sum of Rs.15,000/- with one or two sureties in the like amount;
(ii) The applicant shall inform his latest place of residence and mobile contact number immediately after being released and/or change of residence or mobile details, if any, from time to time to the trial Court, as well as the Anti Corruption Bureau.

The Application is allowed in the aforesaid terms and is accordingly disposed of. Parties to act on the authenticated copy of this order.
