Heard learned counsel for the applicant and learned APP for the State.

This is an application for pre-arrest bail by the applicant, in connection with First Information Report (FIR) No.2364 of 2022 dated 18/12/2022, registered with Sakinaka Police Station, under sections 326, 504, 506 and 34 of the Indian Penal Code, 1860 ("IPC" for short). 3.

It is alleged that there was some dispute between the 2 groups over removing the debris which was kept over a plot of land. Cross FIR came to be filed. The complainant alleged that the applicant assaulted the complainant on his hand with the iron rod. The complainant suffered a fracture 1/3

injury on his hand.

So far as the applicant is concerned, his brother has lodged FIR No. 2365 on 18/12/2022 under sections 307, 143, 147 and 149 of the IPC against the complainant. The applicant was admitted in ICU almost for 10-12 days. It is alleged that the complainant assaulted the applicant on the head with the iron rod.

There are no criminal antecedents reported against the applicant. Considering the nature of the accusations and the injury suffered by the complainant, the applicant can be granted the facility of pre-arrest bail. Hence, the following order.

ORDER

(a) In the event of arrest of the applicantRavishankar @ Ravi Jagannath Verma in connection with FIR No. 2364 of 2022, registered with Sakinaka Police Station, shall be released on bail, on his furnishing P.R. Bond of Rs.15,000/- with one or more sureties in the like amount; (b) The applicant shall report to the Investigating Officer on 17/02/2023 and 18/02/2023 between 11.00 a.m. and 1.00 p.m.

and thereafter as and when called;

(c) The applicant to co-operate with the Investigating Officer;

(d) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police Officer. The applicant shall not tamper with evidence.

The application is disposed of.
