Heard learned counsel for the applicants and learned APP for the State.

This is an application for pre-arrest bail by the applicants, in connection with C.R. No.I-484 of 2022 dated 14/22/2022, registered with Manikpur Police Station, under sections 420 and 34 of the Indian Penal Code, 1860. 3.

It is alleged that in the year 2021, the first informant wanted a room to stay. Applicant no. 2 was working as a broker/estate agent. Applicant no. 2 introduced applicant no. 1 as the brother of the builder. It is alleged that from 1/3

time to time an amount of Rs. 2,45,000/- was paid by the informant to the applicants through Google Pay and cash. After the informant reported the incident to the police, applicants transferred an amount of Rs.65,000/- by Google Pay to the informant's account. There are some disputes about further sums that are claimed by the complainant. 4.

Learned counsel for the applicants states that the applicants are even willing to settle the matter and even willing to deposit the balance of Rs.1,75,000/-, without prejudice to their rights and contentions, with the Investigating Officer within 4 weeks from today, to show their bonafides. The statement is accepted as an undertaking to this Court.

In this view of the matter, having regard to the nature of the accusations, in my opinion, custodial interrogation of the applicants is not necessary. Hence, the following order.

ORDER

(a) In the event of arrest of the applicantsRavindra Shivnayak Singh, Jaykishor Kamlesh Jha, in connection with C.R. No.I-484 of 2022, registered with Manikpur Police Station, shall be released on bail, on his furnishing P.R. Bond of 2/3

Rs.25,000/- each with one or more sureties in the like amount;

(b) The applicants shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police Officer. The applicants shall not tamper with evidence;

(c) The applicants shall report to the Investigating Officer on 21/02/2023 and 22/02/2023 between 11.00 a.m. and 1.00 p.m and thereafter as and when called;

(d) The applicants shall abide by the undertaking given to this Court and in case of breach of the undertaking, learned APP/ complainant is at liberty to apply for the cancellation of the anticipatory bail granted to the applicants.

The application stands disposed of.
