Heard Mr. Rajendra M. Haridas, learned counsel for the petitioner and Mr. Vaibhav Patankar, learned counsel for the respondent.

Mr.Haridas submitted that this petition was filed challenging the Judgment and order dated 16.8.2013 passed by the learned Principal Judge, Family Court, Mumbai in Interim Application No.52 of 2013 (Exh.10) in Petition No.A-2295 of 2012. By that order, the petitioner herein was ordered to pay Rs.8000/- per month towards maintenance of the respondent and Rs.7000/- per month towards maintenance of minor child pending the hearing and final disposal of the main petition from the date of application, i.e. 4.3.2013. Mr. Haridas submitted that the main Petition itself was disposed of. The petitioner has challenged the final order by filing Family Court Appeal No.5 of 2015. He, therefore, seeks permission to withdraw this Petition as the main

2 / 2 WP/1985/2014 proceedings are disposed of.

On the motion made by Mr. Haridas, the Petition is allowed to be withdrawn. The Petition is dismissed as withdrawn. 4.

In view of withdrawal of the Petition, Civil Application No.1471 of 2014 does not survive and the same is disposed of. (R.G.KETKAR, J.)
