Heard the learned counsel for the parties.

By this civil application, the Applicant seeks to set aside the order dated 10.01.2018 passed by the Registrar (Judicial -I) by which, the writ petition stood dismissed for non removal of the office objections.

Learned counsel for the Applicant submits that the Applicant undertakes to remove all office objections within three weeks from today.

Considering the submission made by the learned counsel for the Applicant and the averments made in the Civil Borey 1/2

spb/ 6caw459-18.odt Application, we are satisfied that the applicant has made out the case for allowing the civil application.

The civil application is allowed in terms of prayer clause (A); which reads thus :

(a) (A) That this Honourable Court may be pleased to set aside the order of dismissal dated 10th January, 2018 passed by this Honourable Court [Coram : A.N. MareRegistrar (Judl.-I)], in writ petition (st.) No. 31810 of 2016 and be pleased to restore the said writ petition (st.) No. 31810 of 2016 back to the file of this Honourable Court and to dispose off the same on merit.

(b) Applicant to remove all office objections in writ petition (st.) no. 31810 of 2016 within three weeks from today, failing which the present civil application shall stand dismissed without further reference to the court. (c) The Applicant to pay cost of Rs.1000/-.

(d) Cost to be deposited with Kirtikar Law Library, High Court, Bombay within three weeks from today and place receipt on record; failing which the present civil application shall stand dismissed without further reference to the court. (B.P. COLABAWALLA,J.) (K. K. TATED J.) Borey 2/2
