Though the Respondents are duly served, no one appeared on behalf of them when the matter is called out. 3.

By this Civil Application, the Applicant is seeking condonation of 127 days delay in fling the First Appeal challenging the Judgment and award dated 19th July, 2012 passed by the Additional Commissioner of Workmen's Compensation, Mumbai in Application (WCA) No. 564/B-86 of 2010 holding that the Respondents/Original Claimants are entitled to sum of Rs. 12,09,960/- with interest @ 12% p.a. 4.

Considering the submission made by the Learned Counsel for the Applicant and the averments made in Civil Application, I am satisfed Laxmi Sontakke

11 CA 4369-13 that the Applicant has made out a case for allowing this Civil Application. Hence, the following order:

Delay in fling the First is condoned.

Civil Application stands disposed of accordingly. c.

No order as to costs.
