The Applicant is seeking regular bail under Section 439 of the Code of Criminal Procedure, 1973.

The incident is of 1st September 2018 and the F.I.R. has been lodged on 2nd September 2018. The applicant has been arrested on 2nd September 2018 in C.R.No. 455 of 2018. 3.

The first Application seeking bail was rejected by learned Additional Sessions Judge, Baramati on 13th March 2019. The second Bail Application has been rejected by the learned 1/3

Additional Sessions Judge, Baramati on 8th July 2020. 4.

The Applicant filed Criminal Bail Application No.2713 of 2021 in this Court. By order dated 17th January 2022, a learned Single Judge (Coram : C.V. Bhadang J.) recorded that after arguing the matter for some time, a learned Counsel appearing for the Applicant withdrew the Application with a request to expedite the trial. Accordingly, the learned Single Judge directed the learned Trial Court to conduct the trial as expeditiously as possible and make an endeavour to conclude the same within one year. Thereafter the present Bail Application has been filed on 9th February 2023, immediately after one year period is over. 5.

A learned Single Judge (Coram : M.S. Karnik, J) by Order dated 5th September 2023 passed in this Bail Application adjourned the Application and requested the learned Trial Court to expedite the trial.

Mrs. Veera Shinde, learned APP states that one witness has been examined and only three more witnesses will be examined. She states that the trial will be concluded within a period of two months.

Accordingly, the learned Trial Court is requested to conduct the trial expeditiously and conclude the same by 31st March 2024.

The Application is disposed of. However, if the trial is not concluded by 31st March 2024, liberty is given to the Applicant to file fresh Bail Application.
