Heard. By this Civil Application, the Applicant seeks to recall the order dated 15.01.2018 passed by this court, by which the Family Court stood dismissed for non prosecution.

Considering the submissions made by the Applicant in person and the averments made in the Civil Application, we are satisfied that the Applicant has made out a case for allowing the Civil Application. The Applicant has agreed to pay cost of Rs.5000/-. Considering these facts, Civil Application is allowed in the following terms.

Family Court Appeal No.88/2010 is restored to file for hearing on merits.

The Applicant to pay cost of Rs.5000/-.

Cost shall be paid to Kirtikar Law Library, High Court, Mumbai, within three weeks from today and place on record a receipt to that effect, failing which the Civil Application shall stand dismissed without further reference to the court. e.
