On the earlier occasion i.e. on 05/08/2022, the application was permitted to be withdrawn, when I expressed my disinclination to release the applicant on bail, in the wake of the material compiled against him in the charge-sheet. The learned A.P.P. has invited my attention to the antecedents of the applicant, where he was convicted for committing a similar offence in the year 2011. There are also externment proceedings initiated against him alongwith the chapter proceedings.

The above antecedents speak of the possibility of the applicant, either not being available for trial or to commit a further offence, if released on bail.

2/2 1 BA-478-23.odt Apart from this, considering the accusations levelled against him and, since, he is an author of the injury caused to the complainant, an innocent person, who had no enmity with him, I do not think that the liberty can be conferred upon him. Resultantly, despite the application being fled on the second occasion, I deem it appropriate to reject the same. 2.

The application is, therefore, rejected.
