Prayer for transfer is opposed by the non-applicant/wife on the ground that she is not getting any maintenance. That being so, there is mounting financial amount viz. repayment of housing loan and also has to maintain seven years old daughter. 2.
I have appreciated the submissions.

Statement made by the counsel for the applicants that the objections in his proceedings are already removed, is accepted. 4.
In the aforesaid background, so as to avoid overlapping of finding on the same set of facts between the same parties, prayer for transfer is allowed in terms of prayer clause (b). BGP.

It is directed that if pleadings by filing reply to the maintenance proceeding is not completed by the applicant within period of four weeks from today, the Court below shall be at liberty to proceed ahead with the hearing of the same irrespective of the reply of applicant. Applicant is permitted to place on record affidavit-in-reply within four weeks irrespective of the further schedule date of hearing.
