This is an application for anticipatory bail in C.R. No. 397 of 2020 registered with Chunabhatti Police Station, Mumbai for offences under Sections 326, 506 of Indian Penal Code. 2.
The FIR was lodged on 13th November, 2020 by Mohan Narayan Chouhan. It is alleged that on 12th November, 2020 the applicant who is brother-in-law of the complainant had picked up quarrel with him and assaulted by stick on his left hand which has caused injury. The injury is in the nature of swelling on hand which Digitally signed by RajeP. Aher Date:
2021.03.01 13:23:54 +0530 is simple injury. The complainant in this case is the brother-in-law of RajeP.
Aher the applicant. Cross case has been registered against the complainant vide C.R. No. I - 398 of 2020 registered with same Police Station for Sajakali Jamadar
24-ABA-487-2021.doc offences under Sections 454, 452, 387, 384, 506(2), 323, 504 & 427 of IPC. The applicant has married to sister of complainant. It is submitted that the complainant had grudge against the applicant. Looking at the nature of the allegations, custodial interrogation of the applicant is not necessary. Hence, I pass the following order:
ORDER
(i) Anticipatory Bail Application 487 of 2021 is allowed; (ii) In the event of arrest of the applicant in connection with in C.R. No. 397 of 2020 registered with Chunabhatti Police Station, Mumbai, the applicant be released on bail on furnishing P. R. Bond in the sum of Rs.25,000/- with one or more sureties in the like amount;
(iii) The applicant shall attend the investigating officer on 9th, 10th & 11th of March, 2021 between 11.00 a.m. to 1.00 noon and thereafter as and when called for till filing of charge-sheet.
(iv) Anticipatory Bail Application stands disposed of accordingly.
