This is an application filed under Section 438 of the Code of Criminal Procedure, 1973 for anticipatory bail. 2.

The applicant is apprehending his arrest in Crime No. 305 of 2022 registered at Khadki Police Station, Pune for the offences punishable under Sections 354, 384, 504, 506, 140, 171 of Indian Penal Code. 3.

I have heard the learned Counsel for the applicant and the learned APP for the State.

According to the victim herself there was a love affair between her and the applicant. According to her, the applicant clandestinely got transferred certain personal data from her mobile to his mobile phone. It is Kanchan P Dhuri 1 / 2

18-ABA-455-2023.odt alleged that when she told the applicant not to contact her, he started threatening her to make personal data viral and for not doing so he made her to pay him Rs.75,000/-.

The applicant who appears to be law student, has filed affidavit-cum-undertaking that he does not have any personal data of the victim. Apart from it, the applicant has filed on record documents to show that he has sent money to the victim. The applicant without prejudice to his rights and contentions deposited Rs.75,000/- with this Court. Considering the overall facts and circumstances, I am inclined to grant anticipatory bail to the present applicant. In the result, the following order is passed :

(i) Application is allowed.

(ii) In the event of arrest of the applicant - Sunilkumar Sitaram Meena in Crime No. 305 of 2022 registered at Khadki Police Station, Pune for the offences punishable under Sections 354, 384, 504, 506, 140, 171 of Indian Penal Code, he shall be released on furnishing P.R. Bond in the sum of Rs.25,000/- with one or more sureties in the like amount. (iii) The applicant shall attend the concerned police station as and when called by the Investigating Officer and shall co-operate in the investigation.

(iv) The applicant shall not contact the victim either directly or indirectly.
