The learned counsel for the applicant submits that the applicant is in custody since June, 2013. His earlier application was rejected vide order dated 30.6.2017. It is submitted that in the present case, charge is framed. However, there is no progress in the trial. 2.

Taking into consideration the fact that the applicant is in custody for almost four years without there being any progress in trial,the learned Addl. Sessions Judge, Khed, shall make every endeavour to expedite the trial and conclude the recording of evidence, as far as possible, within ten months from the date of receipt of this order.

The learned counsel for the applicant, upon instructions, seeks liberty to withdraw the application. Liberty as prayed for is granted in the interest of justice. The application stands dismissed as withdrawn. (SMT. SADHANA S.JADHAV, J.)
