He submits that during the pendency of the said Application, charge-sheet has been filed in the said case and hence, the Applicant intends to withdraw this application with liberty to file an Application before the learned Sessions Judge, after filing of the charge-sheet.

Accordingly, the Application is disposed of as withdrawn with liberty as prayed. It is made clear, that this Application has not been heard on merits.
