This petition is directed against the order dated 03.02.2017 passed by the learned Ad-hoc Judge, Civil and Asst. Sessions Judge, City Civil Court, Dindoshi, Mumbai thereby rejecting the application below Exhibit 57 for calling Mrs.Waradkar, Assistant Registrar, City Civil Court, Dindoshi to prove affidavit dated 25.02.2010. A report was given by the Assistant Registrar, City Civil Court, Dindoshi that Mrs. Waradkar is expired and therefore, the said application was rejected. 2.

The learned counsel for the petitioner submits that any officer in the place of Mrs. Waradkar can be called.

The learned counsel for the respondents submits that no such application is made before the trial Court for calling of successor.

In view of the above, no order is required in this Writ Petition and the petitioner may move the application before the trial Court for calling the successor of Mrs. Waradkar. Hence, Writ Petition is disposed of. (MRIDULA BHATKAR, J.)
