This Writ Petition is preferred for cancellation of non-bailable warrant issued against the Petitioner by the 59th Court of Metropolitan Magistrate, Kurla, Mumbai in C.C. No.6100024/SS/2013, on failure of the Petitioner-Accused to appear before the said Court and adopting the delaying tactics.

The learned counsel for the Petitioner gives an undertaking to this Court that he will appear before the Trial Court on the scheduled date i.e. 28th February 2016 and proceed with the matter without asking for an adjournment and without any further delay.

In view thereof, the Petition is allowed. Non-bailable warrant issued against the Petitioner is cancelled.
