The learned counsel for the Petitioner seeks leave to withdraw the Writ Petition which challenges the order dated 5 December 2015 in Civil Miscellaneous Application No.35 of 2014 passed by the learned District Judge, Barshi refusing to condone delay in filing first appeal, as he states that second appeal is maintainable.
