This is an application for pre-arrest bail in connection with C.R. No.41 of 2020 registered with Thane Nagar Police Station under Section 402 and 406 of the Indian Penal Code. 2.

Applicant was granted interim protection by Order dated 23 February 2021. It appears that the dispute between the Complainant and the Applicant is with regard to alleged failure of the Applicant to make payment in respect of goods supplied. 3.

The learned APP submits that the charge-sheet against Applicant has already been filed. He however complains that after securing interim protection from this Court on 23 February 2021, Applicant has not bothered to remain present in police station even once. He would request that the Applicant be directed to present Page No.

Mr. Shivarkar, the learned counsel appearing for Applicant assures the Court, after taking instructions from his client, that the Applicant shall remain present in the police station on the date and time fixed by the Court.

Since Applicant is already under interim protection as per order passed by this Court on 23 February 2021 and since charge-sheet has already been filed, in my view, the hearing of the present application need not to be deferred any further. 6.

Accordingly, Interim protection granted by this Court on 23 February 2021 is made absolute subject to condition that the Applicant shall remain present before the Thane Nagar Police Station on 28 March 2024 at 11:00 a.m. and also subject to condition that the Applicant shall attend the Court of the learned Magistrate on each date, unless exempted. With the above directions the Anticipatory Bail Application is disposed of.
