This is an application for condonation of delay of 321 days in preferring the application or leave to file appeal. 2.

Mr. Upadhyay, the learned counsel for the respondent No.1 vehemently opposed the application and submitted that no sufficient reasons are given by the applicant for condoning the said delay. He submitted that if this Court is inclined to condone the delay, the applicant may be saddled with cost.

For the reasons stated in the application and in the interest of justice delay is condoned subject to payment of

2 /2 34-appln. 88-18 cost of Rs.20,000/- to be paid to the High Court Legal Services Committee within a period of four weeks from today.

It is made clear that payment of cost shall be the condition precedent for condonation of delay. In view of the above, the delay is condoned. Application is allowed in terms of prayer clause (a) subject to aforestated condition of payment of cost. (A.S.GADKARI, J.)
