This is an application for condonation of delay in preferring an appeal by the applicant/ accused, who has been convicted of offences punishable under Sections 4, 6 and 8 of the Protection of Children from Sexual Offences Act, 2012, and under Sections 363, 366 and 506(2) of the IPC by the learned Special Judge, Sindhudurg, at Oros, vide judgment and order dated 21st November 2016 in Special Case No.44 of 2015.

23-APPA-246-2017.doc The criminal application is registered on the basis of letter send the applicant/ accused through jail. The reason mentioned is financial crunch and the resultant inability to engage a lawyer for filing an appeal.

Though the learned APP opposed the application by stating that no sufficient ground is made out, for the stated reason, the application is allowed.

The delay in filing the appeal is condoned.
