DATED : 26th JULY, 2022 P.C:- The learned APP, on instructions, state that the Sessions case no. 840 of 2019 which is being tried against the accused for offence punishable under section 452, 354, 376, 377, 323, 504, 506 and 506 (II) is under progress. He state that three witnesses have been examined and now three more are required to be examined which include the Investigating officer. Since the Roznama reveal that in the sessions case the evidence is in progress, the city sessions court Mumbai (39 Additional Sessions Judge) is requested to conclude the trial within a period of 3 months from today.

From the Roznama it appears that the prosecution is Ashish Mhaske

2/2 49 BA 817.21.doc requesting for a report from FSL, obviously it is done at the fagend and if the FSL report do not come, for which prosecution is to be blamed, for that as it did not insist upon the report being provided when the trial commenced, the learned Judge shall proceed with the trial.

With the aforesaid direction the application is disposed off.
