The State of Maharashtra and ors.
....Respondents ****** Mr. Anilkumar R. Joshi, for the Petitioner Mr. V. B. Thadani, AGP for the State ****** CORAM : V. M. KANADE & M.S. SONAK, JJ.
DATE : AUGUST 3, 2016 P.C. :
1.
The grievance of the Petitioner is that his application for reimbursement of medical expenses incurred by him for the treatment of his mother to the tune of Rs.3,32,681.24 was not reimbursed on the ground that the Petitioner's mother was getting monthly pension of Rs. 5,900/-.
2.
The learned counsel for the Petitioner submitted that there is a GR dated 19th March, 2005 which states that the cases where the persons, who are not eligible for getting medical reimbursement, such cases should be considered by the Special Committee, which has been constituted by the said G.R. It is submitted that the case of the Petitioner was not referred to this Committee. 3.
Without going into the merits of the case, we are of the view that the
2/2 WP 5107 of 2016 Committee constituted by virtue of the GR dated 19th March, 2005 shall examine the Petitioner's case and pass the order within four weeks. If possible, the Petitioner may be given hearing by the Committee and, in any case, the Petitioner may be communicated the order passed by the Committee. It is clarified that however, this is without prejudice to the rights and contentions of the Petitioner that he is eligible to get the medical treatment under the said G.R. With these directions, the writ petition is disposed of. M.S. SONAK, J.
