Learned Counsel for the Petitioner placed on record communication received by him, being the communication dated 23rd February 2018 sent to him by the authorised signatory of PetitionerTrust. By the said communication, the Petitioner has instructed his advocate to withdraw the writ petition with liberty to file fresh application under section 24 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.

In the light of above, the learned Counsel for the Petitioner seeks leave to withdraw this petition with liberty to file fresh application under section 24 of the Act of 2013. Leave with liberty as prayed for is granted. Writ petition is allowed to be withdrawn and patilsr 1 / 2

dismissed as such.

It is clarified that this Court has not gone into merits of the matter and in the event such an application is filed by the Petitioner, the same shall be decided by the said authority independently, on its own merits and in accordance with law.
