Heard learned Counsel for the petitioner.

The learned counsel for the petitioner seeks permission to withdraw the present Contempt Petition with liberty to file appropriate application under Order 39 Rule 2A of Code of Civil Procedure, 1908 for violation of order dated 27.05.2011 passed by the Court of Small Causes, Mumbai (Bandra Branch) below Exh.22 in R.A.E. Suit No. 228/529 of 2000. Same is allowed.

Contempt Petition stands dismissed as withdrawn with liberty to file application, if they so desire, under Order 39 Rule 2A of Code of Civil Procedure, 1908.
