Learned APP makes a statement on the instructions of the officer, who is present in Court that as of today, the involvement of the applicant is not seen in the investigation done so far. She submitted a report which is taken on record and marked "X" for identification. She, therefore, submits that in the event the investigating officer intends to arrest the applicant, the investigating officer will give

ABA 257-15.doc 72 hours notice to the applicant to enable him to file a fresh application seeking anticipatory bail. In view of the statement made by the learned APP, learned counsel for the applicant seeks leave to withdraw this application.

Accordingly, the Application is disposed of as withdrawn on the aforesaid terms. The investigating officer to give 72 hours notice to the applicant in the event the investigating officer intends to arrest the present applicant.
