Learned APP, on instructions, seeks leave to withdraw the aforesaid application as the trial has concluded and therefore, nothing now survives for consideration in the aforesaid application. 2.

By the aforesaid application, the applicant - State of Maharashtra had impugned the order dated 29th August, 2017 passed by the learned Sessions Judge, Nashik in Criminal Miscellaneous Application No. 91 of 2016, by which, the learned Judge allowed the respondent's Wakodikar 1/2

It appears that in the interregnum, during the pendency of the aforesaid application, the trial has concluded and the respondent No.2 has been acquitted of the offences for which, he was tried. In view of the aforesaid, nothing survives for consideration in the application.

Accordingly, application is disposed of as withdrawn, as it is rendered infructuous.
