By this Civil Application, the Applicant is seeking order to transfer the First Appeal No. 1703/2009 which is transferred on 10/07/2017 to the District Court at Solapur and numbered as Civil Appeal No. 350 of 2012 and pending on the file of the Learned Adhoc District Court at Solapur to the High Court on Appellate Side for hearing and final disposal with First Appeal No. 607/2010.

3. The Learned Counsel for Respondent Nos. 3 and 6 who are the Appellants in First Appeal No. 607/2010 submit that their First Laxmi 1/2

20 CAF 2159-14.doc Appeal is already transferred to the District Court at Solapur in the year 2015 for hearing and final disposal on its own merits.

4. In view of subsequent development, connected First Appeal already transferred to the District Court at Solapur, nothing survives in this Civil Application.

5. Hence, the following order:

a. Civil Application stands rejected.

b. No order as to costs.
