By consent, impugned order dated 17.01.2018 passed by the Tahasildar, Kagal, District-Kolhapur is set aside. Parties are directed to appear before the Tahasildar, Kagal, District-Kolhapur on 11.03.2019 and produce the copy of this order. On appearance of the parties, Tahasildar, Kagal is directed to fix a date of hearing of proceeding pending before him and decide the same on merits without influenced by its earlier order dated 17.01.2018 passed in the matter. While deciding the matter on merit, the Tahasildar shall also decide the issue of jurisdiction and any other legal issues raised by the rival parties.

It is clarified that this Court has not examined the merit of the case and the concerned Authority shall decide the case on its own merits. All contentions raised in Petition are kept open for argument. 4.

Writ Petition is disposed of in above terms.
