By this petition, under Article 226 of the Constitution of India, Petitioner is seeking direction against the Respondent to decide Application dated 05.01.2018 in respect of alternate land i.e. Gat No.239 admeasuring 2 Hector 80 Ares at Village Dingrajwadi, Tal. Shirur, Dist. Pune.

It is the contention of the petitioner that the said Application is not decided by the Respondent State till today. Mohite 1/2

909 wp4158-18.doc The learned A.G.P. for the Respondent State submits that Petitioner's Application dated 05.01.2018 is already decided by them on 10.01.2018 and communicated to the Petitioner. To that effect, she has placed on record, photocopy of letter dated 10.01.2018. Same is taken on record and marked 'X' for identification. The learned counsel for the Petitioner submits that in view of subsequent development, Petitioner may be permitted to withdraw the present Writ Petition with liberty to challenge the said order by way of appropriate proceeding. To that effect, he has given in writing. Same is taken on record and marked 'X-1' for identification. Same is accepted. Writ Petition stands dismissed as withdrawn with liberty as prayed.

No order as to costs.
