The petitioner is challenging order dated 29 January 2024 passed by the Revisional Authority entertaining challenge to the proclamation under Rule 107 (11) (c) of the Maharashtra Cooperative Societies, Rule, 1961.

Learned Advocate for the petitioners, on instructions, states that the petitioners have deposited 50% recoverable dues. He, further states that the auction purchaser failed to comply with mandatory provisions of Rule 107 (11) (g) & (h), by failing to deposit 15% of sale price immediately.

In view of the aforesaid submissions, it would be in the

27-wp-1963-2024.doc interest of justice that the interim relief granted earlier needs to be continued. Hence, following order:

i) The impugned order dated 29 January 2024 passed by the Divisional Joint Registrar in Revision Application No.334 of 2023 is continued during pendency of revision.

ii) The Divisional Joint Registrar shall decide the revision within two months from the date of appearance of the petitioners. iii) The petitioners shall appear before the Divisional Joint Registrar on 14 February 2024.

The writ petition stands disposed of in above terms. No costs.
