The Applicant is seeking anticipatory bail in connection with C.R.No. 545 of 2020 registered with Kamothe Police Station, Navi Mumbai, under sections 307, 324, 143, 144, 323, 504 r/w. 149 of the Indian Penal Code (for short '

IPC'

) and under section 3 and 25 of the Indian Arms Act.

At the outset, learned APP has produced a report of the Police Inspector (Crime) Kamothe police station, Navi Mumbai addressed to the public prosecutor. She has tendered this report Gokhale

X' for identification. The report mentions that the investigation did not reveal participation of the present applicant in this offence and, therefore, the police were filing report U/s.169 of Cr.p.c. as far as present applicant and four others are concerned.

In view of this statement and report, learned counsel for the applicant, at this stage, does not press this application. 4.

In view of this, application is disposed of as not pressed. However, it is made clear that, in case, if in future, the investigating agency seeks to arrest present applicant in connection with this offence, they shall give three clear working days' notice to the present applicant to enable him to take recourse to appropriate remedy.

With this direction, the application is disposed of as not pressed.
