In such circumstances, the criminal bail application is disposed of as withdrawn.

It is made clear that if the applicant approaches the learned Magistrate with an application for bail, the learned Magistrate shall decide the same on its own merits and in accordance with law, without being influenced by the withdrawal of the present application. 4.
