Heard the learned counsel for the applicant.
This application is preferred by plaintiff for condonation of 160 days delay in filing Appeal from Order challenging the order dated 2.8.2014 passed by Bombay City Civil Court, Mumbai in Notice of Motion at Exhibit 5 in L.C.Suit No.2371 of 2008.
Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for Mohite 1/2
28 caa287-15.doc allowing the present Civil Application. Hence, following order:
a) Delay of 160 days in filing Appeal from Order is condoned.
b) Civil application stands disposed of accordingly.
c) Office is directed to place Appeal from Order on board for admission on 3.8.2015.
d) Interim protection, if any, granted earlier to continue till next date.
