By this application under Section 24 of the Code of Civil Procedure, 1908, the applicant-wife has prayed for transfer of M.J. Petition No.A-608 of 2014 pending in the Family Court at Bandra to the Court of Civil Judge, Senior Division, Ratnagiri. Respondent has instituted that Petition under Sections 10 and 13(i-a) of the Hindu Marriage Act, 1955 against the applicant for divorce. Respondent has tendered photocopy of driving licence. The same is taken on record and marked 'X' for identification.

Respondent states that the controversy between the parties is amicably settled. He is ready and willing to cohabit with the applicant. He is not interested in prosecuting the Petition instituted by him. He, therefore, seeks permission to withdraw that Petition. The applicant has also expressed her readiness and willingness to cohabit with the respondent.

In view thereof, on the motion made by the respondent, M.J. Petition No.A-608 of 2014 pending in the Family Court at Bandra is allowed to be withdrawn and is disposed of as such. 5.

Respondent states that the next date of hearing before the Family Court is 28.04.2015. He assures that he will produce authenticated copy of this order before the Family Court for the formal withdrawal of the Petition.

In view thereof, Miscellaneous Civil Application is disposed of as infructuous. All the parties including the Family Court at Bandra, Mumbai shall act upon the authenticated copy of this order. (R. G. KETKAR, J.) Minal Parab 2/2
