Heard learned Counsel for the parties.
This application is preferred by respondent for early hearing of Second Appeal no. 97 of 2000 on the ground that applicants are Senior Citizens. In support of this contention, the learned Counsel for the applicant relies on Exh.A i.e. identity card issued by Maharashtra State Road Transport Corporation as well as Election Card issued by Election Commissioner of India.
Office note shows that Second Appeal is not ready for final hearing for want of print and paper book.
Considering the submissions made by learned counsel for the applicant, averments made in civil 1/3
application and as the applicant is Senior Citizen, I am satisfied that applicant has made out the case for allowing the civil application.
Hence, following order is passed:
a) Hearing of Second Appeal no. 97 of 2000 is expedited.
b) Office is directed to place the Second Appeal for final hearing in weekly board as per its turn in Senior citizen list, as and when Second Appeal will be ready for hearing.
c) Civil Application stands disposed of accordingly.
