Heard learned counsel for the applicant and learned APP for the State.

This is an application for pre-arrest bail in respect of the offence punishable under Sections 353, 332, 506 (2) read with 34 of the Indian Penal Code, 1860 in connection with C.R. No.333 of 2022 dated 16/12/2022 registered with Dombivali Railway Police Station.

The first informant is working with Maharashtra Police attached with Dombivali Railway Police Station designated as Women Police Naik. The date of the incident is 1/3

16/12/2022. On a report of the Senior Railway Ticket Inspector that the applicant was found travelling in first class compartment with second class ticket, instead of paying the fine the applicant started quarreling with the Senior Railway Ticket Inspector. It is alleged that the applicant manhandled Senior Railway Ticket Inspector thereafter she brought to Dombivali Railway Police Station. At the police station the brother and the relative manhandled the first informant, abused and threatened her. So far as the other co-accused are concerned, they have been released on bail. Considering the nature of the allegations, the applicant being a woman, she can be asked to co-operate with the investigation and can be released on anticipatory bail.

Learned counsel for the applicant on instructions undertakes to co-operate with the investigation, handover the copy of the receipt and further extend all possible cooperation. Hence, the following order :-

O R D E R

(a) Application is allowed.

(b) In the event of arrest in connection with C.R. No.333 of 2022 dated 16/12/2022 registered with Dombivali Railway Police Station, the applicant-Shashi Vishwadev Pande shall be released on bail on furnishing P.R. Bond to the extent of Rs.15,000/- with one or more sureties in the like amount.

(c) The applicant shall report to the concerned police station on 19/02/2023 between 11.00 a.m. and 1.00 p.m.

(d) The applicant to co-operate with the Investigating Officer.

(e) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police Officer and shall not tamper with evidence.

(f) The applicant shall furnish the details of her residential address and phone number to the investigating officer.
