Heard learned counsel for the applicant and learned APP for the State.

This is an application for pre-arrest bail in respect of the offence punishable under Sections 353, 332, 506 read with 34 of the Indian Penal Code, 1860 and under Section 138 of the Indian Railways Act, 1989 in connection with C.R. No.331 of 2022 dated 15/12/2022 registered with Dombivali Railway Police Station.

The first informant is working as Senior Railway Ticket Inspector at Dombivali Railway Head Quarter. The date of 1/3

the incident is 15/12/2022. It is alleged that the applicant was travelling in first class compartment with second class ticket. She quarreled with the Senior Railway Ticket Inspector. It is alleged that she refused to pay fine of Rs.365/- and started misbehaving with the first informant i.e. Senior Railway Ticket Inspector. Thereafter, she was taken to Dombivali Railway Police Station.

Having regard to the nature of the allegations, the applicant can be released on anticipatory bail. The applicant is a woman and on instructions learned counsel for the applicant submits that the applicant is willing to co-operate with the investigation. Hence, the following order :-

O R D E R

(a) Application is allowed.

(b) In the event of arrest in connection with C.R. No.331 of 2022 dated 15/12/2022 registered with Dombivali Railway Police Station, the applicant-Shashi Vishwadev Pande shall be released on bail on furnishing P.R. Bond to the extent of Rs.15,000/- with one or more sureties in the like amount.

(c) The applicant shall report to the concerned police station on 19/02/2023 between 11.00 a.m. and 1.00 p.m.

(d) The applicant to co-operate with the Investigating Officer.

(e) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police Officer and shall not tamper with evidence.

(f) The applicant shall furnish the details of her residential address and phone number to the investigating officer.
