The Applicant is seeking regular bail in Crime No. 66 of 2015 for an offence punishable under Sections 307, 120-B, 143, 144, 147, 148, 149 of Indian Penal Code, Section 3 (25) (1) (b), 5 (27) (1), 4 (25) of Arms Act, Section 37 (1) (3) read with Section 135 of Maharashtra Police Act and Section 3(1)(ii), 3(2), 3(4) of the Maharashtra Control of Organized Crime Act 1999 . The Applicant is arrested on 14th June 2015.

It is claimed that the Complainant and the other witnesses have turned hostile during the trial. In the other crime being Crime No. 68 of 2015 the Applicant is already released on bail. 3.
The learned APP opposed the claim on the ground that the Applicant might tampered the witnesses.

Considering the fact that the Complainant and the other witnesses have turned hostile and in the another crime the Applicant is already released on bail, in my opinion, a case for grant of bail is made out. Hence, the following order.
ORDER
(A) The Applicant be released on bail in Crime No. 66 of 2015 for an offence punishable under Sections 307, 120-B, 143, 144, 147, 148, 149 of Indian Penal Code, Section 3 (25) (1) (b), 5 (27) (1), 4 (25) of Arms Act, Section 37 (1) (3) read with Section 135 of Maharashtra Police Act and Section 3(1)(ii), 3(2), 3(4) of the Maharashtra Control of Organized Crime Act 1999 on executing PR Bond of Rs. 50,000/- with one or more sureties in the like amount.
3/3 Yadav 25.ba.492.19 (B) The Applicant shall remain outside the revenue jurisdiction of Pune District, but for attending the trial.
(C) In case if the Applicant is found involved in the similar type of offence, prosecution is at liberty to move for cancellation of bail. 5.
