Learned Advocate for the applicants submits that the appellant Nos.2 to 8 have taken out this application for being deleted from the array of parties in the appeal.

Learned Counsel for respondent Nos.1A to 1D is present. Though the State has been served, nobody is present on its behalf. 3.

It is submitted by the learned advocate for the applicants, who are also some of the appellants, that they have settled the matter with the respondents in view of consent terms dated 3.5.2014 filed in Regular Civil 1 / 2

caf.672.2016_915.doc Suit No.14 of 2014 before the Civil Judge, Junior Division, Panvel. Therefore, they do not want to pursue the appeal and hence, they are to be deleted from the array of the appellants in the First Appeal No.829 of 2001.

In view of this, the application is made absolute in terms of prayer clauses (a) and (b). Amendments to be carried out by appellant Nos.1A to 1D accordingly.
