Having heard the learned Counsel for the parties, we are inclined to dispose of this Public Interest Litigation by directing respondent No.1 Secretary to consider and take appropriate decision in regard to the petitioner's grievance treating this Petition as representation.

It is open for the petitioner to submit fresh representation also before the 1st respondent by tomorrow. We expect that respondent No.1 Secretary shall consider the petitioner's grievance as raised in this Petition as also in the representation as may be filed and take appropriate decision on it as expeditiously as possible, preferably 1 / 2

921.PIL.42-18.doc within a week from the date of receipt of copy of this order. It is also directed that the petitioner be given opportunity of hearing. The petitioner to appear before respondent No.1 Secretary on 26.2.2018 at 11:00 a.m.. The Secretary to hear the petitioner on that date or on any other date within three days from that date.

The Petition is disposed of accordingly.

All parties concerned to act upon an authenticated copy of this order.
