In this Petition, the Petitioner has challenged the judgment and order dated 17 December 2016 passed by the District Judge-1, Islampur, thereby confirming the order dated 28 January 2016 passed by the Trial Court. The Trial Court had refused to grant temporary injunction by its order dated 28 January 2016. 2.

The present Petition is pending since the year 2017 and there has been no injunction in favour of the Petitioner since the year 2016.

The learned counsel for the Petitioner submits that the Suit is pending at the stage of recording of evidence. Therefore, no purpose would be served in entertaining the merits of the present Petition. 4.

The writ petition is accordingly disposed of. (SANDEEP V. MARNE, J.)
