As against the impugned order, the Petitioner has remedy by way of instituting a Second Revision Application u/s 257 of the Maharashtra Land Revenue Code 1966, before the State Government. The Division Bench of this Court, in Letters Patent Appeal No.55 of 2003 decided on 13.07.2005, has held that such second revision application is maintainable. Further the Hon'ble Apex Court in Civil Appeal No.5102 of 2006, in the case of Gurudassing Nawoosing Panjwani Vs. The State of Maharashtra and Others, upheld this position. 1/2

Chittewan P14. WP 2703-16.doc In view of the aforesaid, there is no necessity to entertain the present petition. However, the Petitioner is at liberty to institute a revision petition before the State Government.

With liberty as aforesaid, this petition is disposed of. There shall be no order as to costs.
