The Applicants, who are co-accused apprehending their arrest in connection with the investigation of Crime No. 225 of 2021 registered with Khandeshwar Police Station, New Bombay under Section 420, 406, ,465, 467, 468, 471 read with Section 34 of I.P.C. are seeking pre-arrest bail.

I have heard the learned counsel for the Applicant and the learned APP. Perused record.

A bare perusal of the FIR dated 14.10.2021 filed by Laxman Bhatesara shows that the even as per co-accused who has been Sneha Chavan page 1 of 3

arrested and who is the brother of the present Applicants had represented that the Applicants were not ready to receive the cheque towards the consideration as earlier there were transactions in respect of the said land with Lalita Mishra and Gurunath Phadake. The FIR recites that the signatures of the present Applicants on the Memorandum of Understanding were forged. If that be so, prima facie the complicity of the present Applicants is not shown in the said offence.

The learned APP submitted that the Applicants may be directed to join the investigation and to furnish their specimen signatures.

In that view of the matter, the following order is passed:

ORDER

i) In the event of their arrest, in connection with the investigation of Crime No. 225 of 2021 registered with Khandeshwar Police Station, New Bombay, the Applicants shall be released on bail on executing a PR Bond in the sum of Rs.25,000/- each with one or two solvent sureties each in the like amount. ii) The Applicants shall report to the Investigating Officer on 28.02.2022 and 01.03.2022 between 11.00 a.m. to 1.00 p.m. and as and when required by the Investigating Officer. iii) The Applicants shall furnish their specimen hand writings/signatures to the Investigating Officer, if required and shall co-operate with the investigation.

iv) The Applicants shall not tamper with the prosecution evidence/witnesses.

v) The Criminal application is disposed of in the aforesaid terms.
