P.C. :- This Application has been sent by the Applicant from Jail seeking modification of our order dated 28.10.2013 in Criminal Application No. 236 of 2013 directing that the Applicant be released on bail on executing a PR Bond in the sum of Rs.15,000/- with one surety in the like amount to the satisfaction of the trial court.

By the present Application the Applicant states that the Applicant is unable to provide the surety for the requisite amount and is willing to furnish cash security in lieu of solvent surety. The Application further indicates that the Applicant is willing to deposit Rs.15,000/- in cash in lieu of solvent
APPA 234.15.sxw surety. The Applicant further states that he may be released on acceptance of cash security of Rs.15,000/- for a period of four weeks to enable the Applicant to arrange for a surety of the amount indicated by this Court in its order. 3.
An order was passed on 28.10.2013 directing the release of the Applicant. It is unfortunate that the Applicant could not arrange for a surety of the amount indicated in the order. We, therefore, modify our order and direct the Trial Court to accept cash security of Rs.15,000/-. We further direct that on the Applicant furnishing a cash security of Rs.15,000/-, the Applicant be released on bail for a period of four weeks so as to enable him to furnish the solvent surety as indicated by us in our order dated 28.10.2013. On the Applicant furnishing the surety as indicated by us in our earlier order, the amount of Rs.15,000/- be refunded back to the Applicant. 4.
Application is thus allowed as indicated above. 5.
This order be communicated to the Applicant who is undergoing his sentence in Jail.
