The learned Counsel for the applicant upon instructions seeks liberty to withdraw the application with further liberty to approach Sessions Court under Section 437 of the Code of Criminal Procedure, 1973. The liberty as prayed for is granted in the interest of justice. 1/3

The learned Sessions Court shall not be influenced by the withdrawal of this application.

The learned Counsel has placed on record the first notification issued by the R.B.I. dated 3/11/2016 wherein certain conditions were granted. Certificate of Authorisation under the Payment and Settlement Systems Act, 2007 for Setting up and Operating Payment System in India. At Serial No. 33, there is a mention of GI Technology Private Limited. The payment system authorised is prepaid payment instruments card known as "I Cash". In any case, respective APP appearing in all the applications have categorically submitted upon instructions that MSEB has not entered into any agreement with GI Technology Private Limited and incorrect statement is made before the Sessions Court. The investigating agency shall record the statement of any responsible officer of the RBI seeking clarification as to whether when the consent of the MSCDCL, GI Technology or any other firm with whom they had 2/3

entered into an agreement of collecting bill for making payment for or on behalf of the MSCDCL.

The application stands dismissed as withdrawn and disposed of accordingly.
