Heard the learned A.G.P. for the applicant.
This application is preferred by State of Maharashtra for condonation of delay in preferring the Civil Revision Application to set aside the conditional order dated 5.2.2014 passed by learned Registrar (Judicial-I) by which the First Appeal stood dismissed on Stamp number for nonpayment of deficit Court Fees within time. Said order was passed without issuing notice to other side. Therefore, it is not necessary to issue notice to the respondent.
The learned A.G.P. submits that office of the Government Pleader received the amount for Mohite 1/2
14 cac189-16 payment of Court Fees. He submits that applicant undertakes to pay Deficit Court Fees within four weeks.
Considering the submissions made by the learned counsel for the Applicant and as applicants are ready and willing to pay Court Fees within stipulated time as stated hereinabove, I am satisfied that the Applicant has made out a case for allowing the present Civil Application. Hence, following order is passed:
A) Civil Application is allowed in terms of prayer clause (b) which reads thus:
"(b) that this Hon'ble Court be pleased to condone the delay of 1 year 354 days in preferring the abovementioned Civil Revision Application in First Appeal (ST).
No.3661 of 2014."
B) Civil application stands disposed off accordingly.
