Having gone through the prayers in this application, this Court is not inclined to set aside the order remanding the respondent/accused to the Magisterial Custody. 4.

It however appears that first 15 days of remand, have not yet been over. The investigating officer shall make an application before the concerned Remand Magistrate, either today or

901-APL-157-2023.doc tomorrow asking for converting Magisterial Custody into Police Custody. Learned Magistrate shall on hearing the respective parties, decide the application on its own merit. 5.

Needless to mention that the bail application preferred by the respondent/accused would necessarily be decided on its own merits, provided the application to be moved by the investigating officer would be taken up first for passing orders thereon. 6.

Application stands disposed of accordingly.
