This Civil Application is for recall of a self-operative rejection order passed by Registrar Judicial II for non-removal of office objections. There is delay of 69 days in taking out the present Second Appeal. The delay is explained in the Civil Application. For the reasons stated in the Civil Application, the delay is condoned and the conditional order of Registrar Judicial II dated 5 August 2016 is recalled and set aside and Second Appeal Stamp No.1106 of 2016 along with Civil Application No.1272 of 2016 is restored to file. The Applicant/Appellant shall remove office objections within a period of one week from today, failing which the Second Appeal and the Civil Application shall stand rejected under Rule 5 of Chapter V of the Bombay High Court, Appellate Side Rules, without reference to this Court. Civil Application No.397 of 2017 is disposed of accordingly.
